In July 2025, police arrested a driver who allegedly struck a man and fled the scene. New evidence indicates that the victim may have been asleep at the time of the wreck.

Although the cause is uncertain, the results are certain. A 27-year-old man died on a North County bike path. Investigators believe that the vehicle which struck him travelled at least four miles along that bike path. The collision occurred near the intersection of W. Mission Road and North Pacific Street in San Marcos. Investigators initially thought the victim was walking on the path. But the Medical Examiner’s office concluded the victim was probably asleep.

“I’m shattered, fundamentally shattered,” the young man’s mother said. “I wake up, and I’m hit with this profound breaking of my heart and soul.” She said her son, who struggled with mental health issues, had been homeless for more than a year. She described him as loving, funny and caring. He was known for volunteering at nonprofits, his church and food pantries.

“He saw the beauty in everyone’s souls. He saw the essence of goodness in everyone,” she lamented.

Criminal Responsibility and Civil Liability in Hit-and-Run Accidents

Unless officers catch an early break, as apparently happened in the above story, hit-and-run drivers are almost never apprehended and successfully prosecuted in criminal court. Usually, little physical evidence is available at the scene. Furthermore, these incidents often occur at night in isolated areas. Credible witnesses who see the entire crash and, more importantly, get a good look at the driver, are few and far between.

When these cases go to court, prosecutors must use this flimsy evidence to prove guilt beyond any reasonable doubt. This task is nearly impossible.

Additionally, police and insurance company investigators are not lawyers. Investigators are often unfamiliar with legal loopholes in personal injury matters, such as comparative fault.

Assume Driver A was speeding and Driver B changed lanes without signaling. Most likely, investigators would pin responsibility on Driver A. But because of the comparative fault rule, which divides responsibility between drivers, Driver A could still be eligible for some compensation.
